The 2023 International Commercial Arbitration Training sponsered by APIAC in Chengdu, China was a success

Release time:2023-09-21 02:01:59

On Sept 16, 2023, the 2023 International Commercial Arbitration Training in Chengdu, sponsered by Asia Pacific International Arbitration Chamber (APIAC), Beihai Court of International Arbitration, Beihai Asia International Arbitration Center (BAIAC), and the Macao Institute of International Arbitration, and co-organized by the Center for Commercial Arbitration Studies of the Southwest University of Political Science and Law, was a success. The training attracted more than 200 legal practitioners to participate onsite, including arbitrators, law school teachers, court staff, lawyers and legal specialists. Meanwhile, more than 5,000 legal practitioners participated in the training online.

The speaker Prof. Zuo Weimin, Dean of the Law School at Sichuan University, shared his views on the topic of "Some Practical Issues of Arbitration in China and Research on the Revision of the Arbitration Law of China". He also put forward suggestions on "How to Conduct Arbitration Online" and "Key Issues in the Development of Arbitration". Another speaker Prof. Ma Zhanjun, President of Asia Pacific International Arbitration Chamber, focused on the theme of "Hotspot Issues and Difficulties in the Practice of Commercial Arbitration". He conducted an in-depth analysis of international and domestic arbitration activities from a theoretical and practical perspective.

Prof. Ma pointed out that most international commercial disputes are resolved through arbitration, and international arbitration is a blue ocean in China. Compared with litigation, international arbitration awards are more widely recognized and enforced worldwide under the New York Convention(1958). In addition, the Arbitration Law of the People's Republic of China (Revised) (Draft) introduces the concept of the Seat of Arbitration. In international commercial disputes, the Chinese parties can reach an agreement with foreign corporates to consider China as the seat of arbitration. In this way, costs of translation, transportation and others can be reduced hugely and dispute resolution can be more economical. Prof. Ma also said that the Chinese parties are not familiar with international arbitration rules and are at a disadvantage in international arbitration. Therefore, the cultivation of international arbitration talents in China is vital.

The APIAC will organize a high-end international arbitration training course in Singapore in October 2023. This training will cover the theory and practice of arbitration as well as the rules and procedures of international arbitration. The APIAC is committed to building an international arbitration platform, injecting Chinese elements into international arbitration, and providing a more economical way to resolve international commercial disputes.
