【Training News】Summit Forum and Training Session on International Arbitration and Mediation under a Global Perspective

September 21 to 22, 2024, the "Summit Forum and Training Session on International Arbitration and Mediation under a Global Perspective", hosted by the Asia Pacific International Arbitration Chamber Hong Kong Arbitration Center (APIAC-HKAC), was successfully held in Hong Kong, China. This event gathered well-known experts and senior lawyers in the field of international commercial dispute settlement, and offered a rich learning experience combining knowledge and practice insights to participants from various professional associations of the legal industry, prestigious law firms and corporate legal departments.

During the forum and training session, Mr. Ma Zhanjun, President of the Asia Pacific International Arbitration Chamber, Mr. Norris H.C. YANG, co-founder and senior consultant of YYC Legal, founder and executive director of ADR International Limited, President of Macau International Negotiation and Mediation Association, authorised comprehensive mediator and family mediator of the Hong Kong International Arbitration Centre, Mr. Michael Lee, founder of Michael Lee Chambers, international independent arbitrator, Ms. Ma Susu, Vice President of the Hong Kong Mediation Council, Barrister David Fong, Vice President of the Hong Kong Bar Association, representative of the ICC Commission on Arbitration and ADR in Hong Kong, Mr. Eric Xu, a Hong Kong practicing lawyer, and other distinguished guests, delved into several cutting-edge issues surrounding international commercial arbitration and mediation.

President Ma Zhanjun delivered an in-depth analysis on the topic of "Choosing the Seat of International Commercial Arbitration: Influencing Factors and Practice." He explored that the relationship between the seat of arbitration, the arbitral institutions, and the place of hearings, as well as their applications in legal practice. By combining the current international environment and new developments in Chinese law, he provided actionable recommendations for Chinese enterprises on the choice of arbitral language in international business engagements.

Mr. Norris H.C. YANG addressed the topic of "Procedures and Techniques in International Commercial Mediation," beginning with an exploration of the nature of mediation agreements, drawing upon a wealth of real-world examples, Mr. Norris H.C. YANG demonstrated the essential practical techniques that mediators should employ at various stages of the mediation process, providing attendees with valuable insights and actionable advice.

Ms. Ma Susu presented on two key themes, "The Facilitative Mediation Model with an International Perspective" and "'Experience Sharing on Business Mediation in Hong Kong and Mainland China." Highlighting the differences in commercial mediation experiences between Mainland China and Hong Kong, Ms. Ma Susu's presentation included a live mediation simulation, which gave participants a first-hand experience of the mediation process and the techniques involved.

The following day, Mr Michael Lee focused on 'International Arbitration Procedures,' primarily from the perspective of a lawyer. He led the participants through a systematic analysis of challenging issues in arbitration procedures, such as document preparation, expert testimony, and strategies for debate and negotiation. Additionally, he invited participants to share legal experiences from their respective fields.

Barrister David Fong, delivered a specialized lecture titled "Experiences and Lessons from Successful Challenges to Arbitration Awards in Hong Kong." He emphasized the analysis of how specific provisions of arbitration law are differently applied in practice between Hong Kong and Mainland China, providing insights into the nuances of legal procedures in both jurisdictions.

Mr. Eric Xu focused on the common issue of "Interim Measures and Cross-Border Enforcement in International Commercial Arbitration." Drawing from multiple perspectives including those of the parties involved, arbitrators, and expert witnesses, he shared practical techniques and insights applicable throughout the arbitration procedure.

The expert lectures and training sessions of this forum have concluded. Following these, under the guidance of the expert instructors, participants engaged in a "Mock Arbitration Tribunal". This immersive experience simulated a real-world arbitration and mediation process, from the reading of the arbitration application and presentation of evidence to the court investigation, on-site defense, and announcement of the arbitral award.

Concluding the event, President Ma Zhanjun emphasized the significant role of Hong Kong as a Special Administrative Region of China in international cooperation. He stated that APIAC-HKAC benefits from the prosperous international economic and trade cooperation network in the region. It serves as a link to cutting-edge international dispute resolution practices and is committed to continuously optimizing and innovating its arbitration service system. President Ma Zhanjun expressed his hope that the successful holding of this forum and training session would enhance the understanding and confidence of all participants to international arbitration and China's arbitration system.

The forum and training session came to a successful ending. To mark the occasion, the expert instructors presented certificates of completion to the participants and organized a group photo session.
