Indonesian Court Grants Enforceability to APIAC (Indonesia) Arbitration Award for the first time

On 3 October 2024, the Asia Pacific International Arbitration Chamber Indonesia Board successfully registered its first arbitration award in the South Jakarta District Court. This is the first time that an Indonesian Court grants legal enforceability to an arbitration award rendered by APIAC (Indonesia).

Article 59 of THE REPUBLIC OF INDONESIA Law No. 30 of 1999 CONCERNING ARBITRATION AND ALTERNATIVE DISPUTE RESOLUTION stipulates that an authentic copy of an arbitration award shall be submitted for registration in a District Court within thirty days of rendering the arbitration award.

In this case, the arbitration clause provides: “the dispute shall be submitted to the Asia Pacific International Arbitration Chamber Indonesia Board. The number of arbitrators shall be 1 (one), and the place of arbitration shall be Jakarta, Indonesia. The arbitration award shall be final and binding on both parties.” Following the Claimant’s submission of the Request for Arbitration to APIAC (Indonesia), the case was heard by a sole arbitrator, who made the arbitration award on 30 September 2024. The Secretariat of the APIAC (Indonesia) registered the arbitration award in the South Jakarta District Court on 3 October 2024.
