Chairman Ma Zhanjun and his delegation from the Asia Pacific International Arbitration Chamber visited the Badan Arbitrase Nasional Indonesia.

On the morning of November 13, 2023, at 10 a.m., the chairman of the Asia Pacific International Arbitration Chamber (APIAC), Ma Zhanjun, and his delegation visited the Badan Arbitrase Nasional Indonesia (BANI), where they were warmly received by the head of the Badan Arbitrase Nasional Indonesia.

Exchange and Sharing: Unique Aspects of Arbitration in Indonesia

During the visit, discussions included the unique aspects of Indonesian arbitration. Firstly, Indonesia distinguishes between domestic and international arbitration in case acceptance, allowing freedom to choose arbitration institutions for both parties without foreign factors' restrictions. Secondly, Indonesian arbitration awards, whether domestic or international, can be recognized and enforced under the Indonesia's Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution. To recognize and enforce international arbitration awards, the arbitrator or their representative should submit an application to the Clerk of the Central Jakarta District Court. Thirdly, the establishment of arbitration institutions in Indonesia follows a 1+8 model. This means that one institution is funded by the state, which is the Badan Arbitrase Nasional Indonesia (BANI), while the remaining eight institutions are non-state-funded arbitration institutions.

During this exchange visit, the head of BANI provided a detailed introduction to Chairman Ma Zhanjun and his delegation about the prominent position of the institution in the field of arbitration in Indonesia.
