The Asia Pacific International Arbitration Chamber Participates in the Sichuan Development Legal Forum, Supporting Sichuan Enterprises in Expanding Globally

On September 6, 2024, Ma Zhanjun, President of the Asia Pacific International Arbitration Chamber (APIAC), was invited to attend the "Sichuan Development Legal Forum" organized by Sichuan Development Holding Co., Ltd., where he delivered a specialized seminar on international arbitration. Representatives from numerous companies, including Sichuan Development Guorun Environmental Investment Co., Ltd., Sichuan Forestry Group Co., Ltd, Sichuan development Guorui Mining Investment Co., Ltd., Sichuan Development International Holding Co., Ltd/ Sichuan Development Aviation Industry Investment Group Co., Ltd., Sichuan Biopharmaceutical Industry Group Co., Ltd., Sichuan Development Industrial Fund Management., Ltd., Sichuan Development Land Asset Operation and Management Co., Ltd., Sichuan Development Urban Construction Investment Co., Ltd., Chengdu Xinzhu Road & Bridge Machinery Co., Ltd., Sichuan Development Securities Investment Fund Management Co.,Ltd., Sichuan Development Emerging Industry Park Investment and Construction Management Co., Ltd., Southwest United Equity Exchange, Sichuan Development Assets Restructuring Investment Co., Ltd, Sichuan Development Big Data Industry Investment Co., Ltd., Sichuan Non-ferrous Technology Group Co., Ltd, Talent Group, and Lead Capital, were in attendance.

President Ma provided an in-depth analysis of the legal risks that Chinese enterprises face when expanding overseas, focusing on the two main methods of resolving international commercial disputes—litigation and arbitration. He highlighted that international arbitration, compared to litigation, offers greater flexibility and practicality in resolving cross-border commercial dispute. Drawing on several real cases, President Ma analyzed key factors in international arbitration, such as the selection of arbitration institutions, the seat of arbitration, applicable law, and language. He identified potential risks and challenges that Chinese enterprises may encounter and offered strategic solutions. He emphasized that in international trade, choosing a third-country arbitration venue and submitting disputes to a third-country arbitration institution often facilitates agreement between the parties involved.

According the "International Arbitration Survey" jointly published by Queen Mary University of London and White & Case LLP, Singapore has become one of the most preferred seats for arbitration globally. President Ma further pointed out that Singapore, with its exceptional legal framework, independent judiciary, and efficient arbitration services, is an ideal choice for arbitration for Chinese companies going global. He specifically noted that language barriers, differences in legal systems, and the diversity of arbitration rules contribute to the relatively high costs of international arbitration, a reality that resonated with the attendees. In response to this issue, President Ma introduced the advantages of the APIAC. As a Singapore-registered arbitration institution, APIAC offers two types of fee structures: on hourly rates and on disputed amount. It also provides multilingual services throughout the arbitration process, including Chinese, English, Indonesian, and Malay, free of charge. This cost-effective approach makes APIAC an especially suitable choice for Chinese companies.

Following the lecture, attendees engaged in a lively discussion with President Ma on topics such as interim measures in international arbitration and the drafting of arbitration clauses in international commercial contracts. President Ma offered comprehensive responses, covering both theoretical and practical aspects of international arbitration management and the development of arbitration practices in China.

Through this specialized seminar, APIAC provided valuable legal advice to Chinese enterprises venturing abroad.
